All dealings with Upper Travel will be on these Terms and Conditions (“Terms”) unless otherwise agreed in writing with Upper Travel.

A. Introduction

These terms and conditions apply to all services offered by “Upper Style Travel” trading as “Upper Travel” (henceforth referred to as “Upper”, “we”, or “us”, or “our”) which has its registered head offices in 20 St. George, 19005 Athens, Greece (Company Registry No. 118965401000). Upper Travel is a licensed Travel Agency by the Greek National Tourism Organization (GNTO) with Registry No 0208Ε60000693501.
Upper provides Transportation Services (hereinafter referred to as “Transport Services” or “Pickups” or “Transfers”), Tours and Trips Services/Products (hereinafter referred to as “Tours” or “Trips”). By making a booking with us in any of these services, you (hereinafter referred to as “Participants” or “Travelers” or “Passengers”, “you”, or “yours”) shall have automatically accepted the terms mentioned herein, confirm that you have fully understood them and have agreed to all of them. B. Terms & Conditions For The Transport Services

1. Description of Transport Services

1.1. We are a licensed private hire operator and a transportation carrier to provide Transport Services.
1.2. Booking a Transport Service with us, means that the Driver/Chauffeur will become the person who will meet and greet you to their city, and/or will transfer you during your stay.
1.3. Specifically, the transport services that you can book through our website are the following: Travelers’ Transport from and to airports, ports, train stations, bus stations, other place of residence, sightseeing, any point of interest in the city, including stop(s) over (for food, activity, photos, etc.)
1.4. At the point you will be welcomed by the Driver/Chauffeur, you will receive products that you may have purchased from us, and/or products that we may distribute free of charge (souvenirs, city maps, etc.).

2. Policies of the Transport Services

2.1. Booking Process Policy

2.1.1. We do not operate our service in every Greek location/city. To find out if we can serve you in your destination, you have to request and check with us.
2.1.2. In order to book your transfer, you need to provide us with some information such as your personal and contact details (email – mobile), the pick-up location, date and time, your drop-off location, flight number in case you arrive by airplane so we can make arrangements in your favor in case there is a delay, the number of passengers and their pieces of luggage in order to arrange for the right vehicle to pick you up, and also your payment information.
2.1.3. Booking requests are made by sending us a completed booking request form or an inquiry email. When a booking transfer is placed with us, you will receive a confirmation email of receipt of your booking transfer and we will provide you with your booking code and the meeting point at the pickup location. We will examine whether we can serve the transfer as a whole, or we have grounds to reject it, according to the provisions of the present Terms.
2.1.4. The confirmation email of receipt of your booking transfer indicates the Base and the Total Prices, respectively according to article G.
2.1.5. The completion of the online booking process along with the acknowledgement email we send to you, does not constitute our acceptance of your request to book a transfer with us, even though on the acknowledgement email of your request. Our acceptance of your request to provide through our website with a transfer, will take place only when we take full payment from you.
2.1.6. We reserve the right to decline a booking order for any reason, including legal and regulatory reasons. If we cannot provide you with the transport service, we will not process your order, we will inform you as soon as possible and, if you have already paid for the products we cannot deliver, we will refund you in full in a timely manner.
2.1.7. You are solely responsible for submitting us your real personal data when booking a transfer with us. You also warrant and represent that you are the holder or have legal rights on the payment cars/ accounts details you provide us with and that there is enough money to cover the value of the Transfer service. We may proceed (however, are not obliged to) in an examination process of the payment details you provide us with when choosing credit card as a payment method or via online providers. In case an error, misleading statement or other problem occurs, we may, at our sole discretion reject your order.
2.1.8. At the time of booking, it is your responsibility to advise us of any special requests such as vehicle child seats or any mobility requirements for transfers. Please note however, these cannot be guaranteed. The EU directive 2003/20/EC (for child seats) states that children must use an appropriate child seat until they reach the age of 12 years or until they reach a height of 135 cm. However for licensed taxis and vehicles (minibuses >3.5tn) there is an exemption. If no child seat is available, children of 3 years of age or over may travel as long as they wear an adult seat belt.
2.1.9. You are advised to check the details of the booking and should notify immediately Upper Travel in case of any errors.

2.2. Traveler Cancellation and Refund Policy

You have the right to cancel a Transport Service already booked with us, at any time by contacting in writing either via the website or via email to info@upper.tours. All cancellation requests are not considered valid until a representative of Upper Travel confirms receipt of the same in writing. The date on which the request is received by Upper Travel will determine the cancellation fees applicable.
Cancellation and refund policy for is as follow:
a) Cancellation up to 5 days prior to the scheduled pick up time: Full refund minus any bank or credit card charges.
b) Cancellation up to 4-2 days prior to the scheduled pick up time: Half refund (50%).
c) Cancellation up to 48 hours prior to the scheduled pick up time: NO refund (0%). It is considered as a last minute and nonrefundable cancellation, resulting in a 100% cancellation fee and no refund to the traveler.

2.3. Traveler Change Request Policy

Upper Travel allows for the eventuality that a Traveler may need to change an agreed service. Change requests must be submitted without delay in written up until 48 hours prior the scheduled pickup time via our website or email to info@upper.tours. All change requests are not considered valid until a representative of Upper Travel confirms receipt of the same in writing. The date on which the request is received by Upper Travel will determine the change fees applicable.
The transport service price might change depending on the changes requested. On that case, the new price will be communicated to you, and the new transfer details will be in effect once there is payment confirmation of the new price where applicable. If the new transfer price is more you should give us your consent to charge your card with the additional amount (if any) due to the change request. If the new transfer price is less, we shall partially refund you. We cannot serve any changes to the details of transfers requested within less than 24 hours prior to the scheduled pickup time. In that case the transfer will either be operated as initially booked, or you can proceed with a cancellation request, as per the B.2.2., Traveler Cancellation & Refund Policy.

2.4. Complimentary Waiting Time Policy

We offer the following complimentary waiting times, depending on the type of the transfer booked:
a) Airports: 45 minutes
b) Ports, Train Stations, Bus Stations: 30 minutes
c) Other pickup locations (e.g. Hotels, BnB’s, Marinas): 15 minutes
The complimentary waiting time starts counting from the scheduled pickup time. Our Driver/Chauffeur will be waiting for you at the pickup location at the time that is scheduled in your booking order so you must make sure that you show up in time, to avoid as being marked as a non-show where all the Terms of the B.2.5.Travelers’ No – Show Policy apply.
For the above a) and b) pickups where the scheduled pickup time is other than the flight/ship/train/bus arrival time and the flight/ship/train/bus is delayed and expected later than the scheduled pickup time, we will inform you whether we can operate the transfer and for any additional cost, so the new arrival time becomes the new pickup time.
For the a) and b) pickups where the pickup time is the flight/ship/train/bus arrival time and the flight/ship/train/bus arrives earlier than the scheduled time, the scheduled pickup time remains the initial scheduled pickup time.
You may request an extra waiting time, and if we can accommodate it, you will be informed for the extra fee that will be charged to you.

2.5. Traveler No-Show Policy

No-Show is defined as a Traveler not being at the pickup location by the end of the complimentary waiting time as per the B.2.4. Complimentary Waiting Time Policy.
If you are not at the pickup location at the scheduled pickup time, and the pickup location is as B.2.4. a) and b) or B.2.4 c), our representative or driver/chauffeur will try to contact you via SMS/WhatsApp/Viber/WeChat or to call you on your mobile phone 15minutes or 5 minutes before the end of the complimentary time, respectively. By the end of your complimentary waiting time, the following will happen:
• If you have not been replied, we have to “release” the Driver/Chauffeur. In this case, the transfer is marked as No-Show and nonrefundable cancellation, resulting in a 100% cancellation fee and no refund to the traveler.
• If you have been replied and you have asked for extra waiting time, and if we can accommodate it, you will be informed for the extra fee that will be charged to you and we will contact the Driver waiting for you.

2.6. Luggage Allowance Policy

When booking your transfer, you are requested to declare the number of pieces of luggage you will be carrying with you. One piece of luggage is considered to be:
• A hand luggage or large sized backpack (<25 lt.)
• A checked-in type, medium suitcase (<100 lt.)
Should you carry any additional items such as extra-large suitcases (>100 lt.), strollers, pet carriers, sports equipment, wheelchairs, scooters, musical instruments, boxes, bulky, etc. you must declare one piece of luggage for each one of those items and add a note to the booking describing them. We have to do this in order to safely and legally accommodate your baggage in the appropriate vehicle-type and ensure your comfort and safety during the transfer. Should you fail to notify us, you will be liable for any additional costs incurred. In any case if the above do not fit in the assigned vehicles will be an extra charge, which you will be informed and agreed.

2.7. Upper’s Changes, Cancellations and Refund Policy

Upper Travel reserves the right to make changes, substitutions or cancel a Transfer if deemed necessary in order to meet unexpected situations. If we have to cancel your transfer will provide you with the following alternatives:
• Travelers will be re-booked at the earliest possible time at the Travelers’ convenience
• Be issued with a refund voucher
• Provide you full refund of all monies paid minus possible expenses that evidentially incurred to Upper Travel.
In all three cases, compensation will be paid as detailed in clause F.1 below unless the change occurs as a result of circumstances beyond our control where clause F.2 will apply.

C. Terms & Conditions For Tours & Trips Services

1. Description of Tours & Trips Services

1.1. Upper provides a range of private tours, guided tours, activities, and other related services to travelers.
1.2. All Tours are described on our website www.upper.tours as well as in the company’s current brochures and they are valid for the time period referred to therein.
1.3. All the information and details of each Tour package (i.e. destinations, prices, duration, times, etc.) are described on our website and contained in the detailed itinerary. Some of our tours may require a minimum number of participants in order to take place.
1.4. Specifically, the tour and trips services that you can book through our website are the following: Half day tours, Full day tours, Day Trips, Multi-day trips and Tailor-made tours.
1.5. In order to make your tour a personal experience for you, we will inform you our Driver/Chauffeur’s and/or the tour guide’s details (name, surname and their mobile phone).
1.6. Booking a tour with us, means that the Driver/Chauffeur and/or the tour guide/escort will become the person(s) who will meet you in order to commence your tour.
1.7. Our Chauffeurs/Drivers (“Tour Insiders”) and our Tour Escorts are very knowledgeable regarding the places of visit but will not guide you at the archaeological sites and museums. A State-Licensed Tourist Guide is eligible to do it and can give more in depth information regarding historic facts. If you would like to include a licensed tourist guide please choose during the booking process.

2. Policies of the Tours and Trips Services

2.1. Booking Process Policy

2.1.1. In order to book your tour, you need to provide us with some information such as your personal and contact details (email – mobile), the pick-up location, date and time, the number of passengers and also your payment information. For multi-day trips a list of passenger names, surnames, and ID passport number must be provided at least one day before the pick-up time of the tour.
2.1.2. Booking requests are made by sending us a completed booking request form or an inquiry email. When a booking tour is placed with us, you will receive a confirmation email of receipt of your booking tour and we will provide you with your booking code and the meeting point at the pickup location. We will examine whether we can serve the tour as a whole, or we have grounds to reject it, according to the provisions of the present Terms.
2.1.3. The confirmation email of receipt of your booking transfer indicates the Base and the Total Prices, respectively according to article G.
2.1.4. The completion of the online booking process along with the acknowledgement email we send to you, does not constitute our acceptance of your request to book a tour with us, even though on the acknowledgement email of your request. 2.1.6. Participation in Tours is only allowed to persons aged eighteen (18) or over and/or to underage persons provided they are accompanied by the persons having parental or supervisory responsibility over them.
2.1.7. You are solely responsible for submitting us your real personal data when booking a tour with us. You also warrant and represent that you are the holder or have legal rights on the payment cars/ accounts details you provide us with and that there is enough money to cover the value of the services. We may proceed (however, are not obliged to) in an examination process of the payment details you provide us with when choosing credit card as a payment method or via online providers. In case an error, misleading statement or other problem occurs, we may, at our sole discretion reject your order.
2.1.8. You are advised to check the details of the booking and should notify immediately Upper Travel in case of any errors.

2.2. Traveler Cancellation and Refund Policy

2.2.1. To organize and carry out the Tours and to offer the proposed services, Upper Travel pays in advance and beforehand considerable amounts of money and undertakes specific compensation obligations in the event of cancellations, either in whole or in part.
2.2.2. You have the right to cancel a Tour or Trip already booked with us, at any time by contacting in writing either via the website or via email to info@upper.tours. All cancellation requests are not considered valid until a representative of Upper Travel confirms receipt of the same in writing. The date on which the request is received by Upper Travel will determine the cancellation fees applicable.
2.2.3. Cancellation and refund policy for is as follow:
a. Full-Day and Half-Day Tours
     • up to 7 days before the scheduled time of the tour. Full refund minus bank or credit card charges.
     • up to 6-3 days before the tour: 50% refund.
     • up to 48 hours or no show: 0% refund, (No refund)
b. Multi-day Trips
     • up to 45 days before the scheduled time of the tour: 100% Refund
     • up to 44-30 days before the tour: 75% refund
     • up to 29-15 days before the tour: 25% refund
     • up to 14 days or no show: 0% refund, (No refund)
c. Large groups (>20 travelers) / Corporates
     • up to 31 days before the scheduled time of the tour: 100% Refund
     • up to 30-15 days before the tour: 50% refund.
     • up to 14 days or no show: 0% refund, (No refund)
d. Tickets & hotels (purchased independently or as part of a trip)
     • Air, bus, rail, ferry tickets: Non-refundable
     • Hotels: As per cancellation policy of each hotel
     • Archaeological Site and Museums: Non-refundable
2.2.4. Given the nature of our tours, different cancellation policy might be applied on special occasions, e.g Tailor-made Tours. In any such case, cancellation & refund terms will be mentioned on your offer. Cancellation & refund terms noted on a proforma invoice are valid for the per se booking and overrule the terms stated on this document.
2.2.5. In the event of cancellation of a Tour by the Traveler, Upper may charge the Traveler’s credit card with the amount of the cancellation fee (in accordance with the cancellation policy applicable to the particular reservation) without requiring the credit card holder’s approval or signature.
2.2.6. It is noted that the aforementioned cancellation fees shall under any circumstances limit the Company’s right to claim any further compensation for any direct or indirect damages suffered due to the cancellation (including any loss of profit and costs/expenses of any nature).

2.3. Traveler Change Request Policy

2.3.1. If you want to change the tour you have booked in any way you must inform us in writing as soon as possible. We will try to help you, although we cannot guarantee that we will always be able to do this as changes are subject to availability at the time.
2.3.2. Where we can make a change, we will charge for any additional services, facilities, or other items changed, at the price which applies on the day the change is made. We do not charge a rate for changes.
2.3.3. Any change to booked 3rd party transportation (by air, ferry, rail, or bus), either purchased independently or as part of a Tour, will be subject to any applicable rebooking or cancellation fee as defined by the relevant third party (airline, etc…) regardless of the date the change request is made.
2.3.4. Any change to accommodation (hotel, BnB, or other) either purchased independently or as part of a Tour, will be subject to any applicable rebooking or cancellation fee as defined by the accommodation supplier (hotel, BnB, or other).
2.3.5. Any change regarding the pre-ordered entry tickets to Archaeological Site and Museums either purchased independently or as part of a Tour, will be subject to any applicable rebooking or cancellation fee as defined by the supplier/organization.

2.4. Upper’s Changes, Cancellations and Refunds Policy

Upper Travel reserves the right to make changes, substitutions or cancel a Tour if deemed necessary in order to meet unexpected situations as following:

2.4.1. Upper’s Change and Refund Policy

We keep the right to change your arrangements before the tour as following:
2.4.1.1. We expect to be able to provide you with all the services we have confirmed to you. However given the nature of the tours, you are expected to be flexible and accommodate the possibility of alternative arrangements having to be made, even at the last minute and without prior notice. Please note that some itineraries are a guide only and may be subject to change. In the vast majority of cases any changes will be regarded by us as minor changes. However, if we consider them a “Major Change” we will advise you as soon as possible. A Major Change includes, by way of example, a major change of destination arising otherwise than as a result of circumstances beyond our control.
2.4.1.2. In the case of a Major Change before the tour we will provide you with the following alternatives:
a. Alternative arrangements of equivalent or of very similar standard and price, if available, or
b. Alternative arrangements of a lower standard together with a refund of the difference in price; or
c. Cancellation of the tour with a full refund of all monies paid minus possible expenses that evidentially incurred to Upper Travel
In all three cases, compensation will be paid as detailed in clause F.1 below unless the change occurs as a result of circumstances beyond our control where clause F.2 will apply.

2.4.2. Upper’s Cancellation and Refund Policy

We keep the right to cancel your arrangements before the tour as following:
2.4.2.1. In the unlikely event we need to cancel arrangements we will tell you as soon as possible. However we will not cancel your arrangements less than 14 days before the tour unless it is for a reason outside our control as provided in clause F.2.
2.4.2.2. If we have to cancel your tour arrangements we will provide you with the following alternatives:
a. alternative arrangements of equivalent or of very closely similar standard and price, if available, or
b. alternative arrangements of a lower standard together with a refund of the difference in price; or
c. Cancellation of the tour with a full refund of all monies paid minus possible expenses that evidentially incurred to Upper Travel
In all 3 cases, compensation will be paid as detailed in clause F.1 below unless the cancellation occurs as a result of circumstances beyond our control (in which case clause F.2 will apply) or we cancel as a result of your failure to pay your booking deposit.

D. Insurance Policy

Upper Travel is insured against Third Party Liability for Bodily Injuries or Death (including compensation for pain and suffering, moral distress) or Material Damage to third parties, which may occur during organized transfers and tours in Greece by the insured and which are caused by negligent acts or negligent omissions of the insured, according to the terms and conditions of the Insurance policy.
We do not include personal insurance with our services. It is your responsibility to take out appropriate travel insurance. Although Upper Travel and its representatives will always strive to ensure safe and enjoyable completion of their transfer and tours they cannot be held responsible for the personal safety of travelers. Each traveler shall be fully responsible for his/her personal health, medical needs and safety.
We are not responsible or liable for loss, damage or theft of luggage or personal belongings, illness, disappointments or frustrations while on transfer or tour, nor responsible for any type of trip interruption due to weather and other unforeseen circumstances. To avoid charges for cancellation due to covered reasons, we highly recommend all travelers purchase individually their own travel insurance (or ask your travel agent). Upper Travel will not be held liable for services provided by 3rd parties.

E. Travelers’ Rights, Obligations, Representations and Warranties

1. You acknowledge and agree that you must avoid any action that may cause road or other safety problems. Particularly, you warrant and represent that during the transfer or tour you will: 
• be decent, courteous and not display inappropriate, abusive, provocative or threatening behavior
• take care that the children, animals and objects to be transferred are done so with responsibility
• carefully observe the instructions for traveling with children and infants
• carefully observe the instructions for the transport of strollers, luggage, bicycles and pets
• always wear your seatbelts at all times
• not smoke and/or not consume food
• not in any ways’ hinder the Driver/Chauffeurs from driving safely
• not attempt to disembark or board the vehicle when it is moving,
• not open windows and doors without the Driver’s consent;
• not carry any illegal materials and substances which are strictly prohibited from our vehicles
2. In cases where you carry animals and/or objects during the transfer and the vehicle is damaged/destroyed or gets dirty somehow due to them, you undertake the obligation to pay for any such damages.
3. The traveler contracting with us is required to inform his/her family members, or the group of travelers he/she represents, about the details of the Transfer or Tour and about these Terms.
4. Light alcoholic beverages may only be consumed on route by persons over the age of 18 and where full responsibility is assumed by the travelers. We will not be held responsible nor liable for you or any part of your party consuming lalcohol nor the consequences that may ensue. All alcohol consumption is your responsibility and at your own risk and you alone shall assume full liability.
5. If you or any person or part of your party damage or soil our vehicle, interior or exterior, including all fittings and fixtures, you will be liable for all costs incurred to rectify said damage.
6. Please check for personal belongings thoroughly before exiting the vehicle. If items are left inside the vehicle, please email us. If the vehicle is required to return with the item, a fee will be calculated and charged based upon the particular vehicles hourly rate otherwise we will contact you to arrange how to get it back. We will not be held responsible for any loss or damage to any personal belongings. Baggage is at owner’s risk throughout the tour(s), unless insured. Small articles, coats, wraps, cameras, smartphones and other hand baggage are entirely under the care of the traveler, who is cautioned against the risk attached to these being left in conveyances.
7. Travelers shall be exclusively responsible for taking care for their luggage, irrespective of the presence or otherwise of any Upper’s representatives, and Upper shall not be liable for any loss or damage to the luggage and the contents thereof.
8. Participation in our tours may require a minimum physical condition, such that you are in the position to walk uphill or climb stairs. Kindly inform of any medical or physical limitation or if you are undergoing a medical treatment. Upper will not be liable for the personal safety of participants, or for the safety of personal items, nor for unforeseen events and incidents that Upper cannot control, prevent or avoid, including (but not limited to) accidents, thefts and illnesses during the transfer or tour. Each participant shall be fully responsible for his/her personal health, medical needs and safety.
9. Travelers are required to fully respect the tour package itinerary and the instructions of Upper’s drivers, guides or representatives and to arrive on time at the meeting places for the various itinerary services to be carried out (trips, guided visits, excursions, meals, etc.).
10. Travelers are required to fully compensate Upper for any damage (positive or negative damage, including any loss of profits) sustained by the Upper due to their acts or omissions with regard to any tour or transfer service.
11. Traveler agrees to pay any and all costs, fees, expenses and charges arising from any act or conduct of Traveler that results in damage or injury to any person. Traveler further agrees to indemnify and hold Upper harmless from and against any such act or conduct.
12. Travelers’ additional stops will incur additional charges subject to the time and distance involved.
13. During the performance of any Transfer or Tour, any complaints by the Travelers should be immediately reported on the spot to Upper’s representative (or, in the absence of any such representative, to Upper) in writing. Upper’s representative shall note on the same form his/her comments on the issue. Where the issue reported cannot be solved on the spot, the Traveler shall submit such complaint to Upper in writing within five (5) business days from the Transfer or Tour completion date, together with any documents or other supporting evidence. Upon expiration of the above deadline, Upper shall not be required to respond to any claim. In any event, any compensation for failure to provide any service or any Transfer or Tour may not exceed the value of each service or the Transfer or Tour service, respectively.

F. Upper’s Rights, Obligations and Limitation of Liability

1. If the tour you have booked fails to be provided by us or our suppliers we will pay you compensation.
1.1. Our liability to you shall be limited to a maximum of the cost payable to us by you for your tour. Compensation will be paid within thirty (30) days following the date the tour was scheduled for.
2. We will not be liable where any failure in the performance of the tour is due to:
2.1.1. you; or
2.1.2. a third party unconnected with the provision of the tour arrangements and where the failure is unforeseeable or unavoidable; or
2.1.3. unusual and unexpected situations and/or events of force majeure, including (but not limited to) inclement weather, any operational capacity reasons, insufficient program participation, circumstances beyond Upper Travel’s control such as strikes, lockouts, lockdowns, riots, wars, whether declared or undeclared, hostilities, civil disturbances, acts of God, acts of governments or other authorities, thefts, pilferage, pandemics, embargos, epidemics, quarantines, custom regulations, delays, or cancellations of or changes in itinerary or schedules or from any causes beyond Upper Travel’s control.
3. Upper Travel reserves the right to add, withdraw, substitute and/or vary advertised tours, prices and departure times for any of its tours without notice. However, reasonable effort will be made to maintain arrangements as advertised.
4. It should be noted that local conditions in Greece may differ from those that exist in the rest of Europe, Asia, Australia, or the U.S.A. The state and conditions of some streets, especially in the historical Centre of Athens, may present accessibility difficulties either for persons with special needs or for vehicles. Access for persons with special needs is not guaranteed. Public areas may not be accessible to persons with special needs.
5. In any event, Upper does not, and cannot, exercise direct control over third parties and it cannot, therefore, be held liable for any wrongdoings and omissions by any third parties unrelated to the provision of the services, and any collaborators thereof, as well as for any emergencies such as cancellations, delays or changes in the itineraries of various transport means (airplanes, boats, buses, trains, etc.) due to causes as detailed in the clause F.2.1.3.
6. The Tour package itinerary may include optional services offered in collaboration with third parties. Upper shall not be liable for any of these optional/additional services or activities, which are not organized by Upper but are only proposed by it. The prices for such optional services offered are determined by the third parties offering such optional services and may vary from time to time.
7. Upper may, for a certain period of time or for a limited number of tickets, offer for sale tickets for specific Tour Packages at more favorable prices, under special cancellation terms. Any such offer by Upper does not entitle other Travelers to claim a similar discount or to cancel their participation without paying the cancellation fee foreseen.
8. Upper may offer special Transfers or Tours at special prices or at discount prices and under special terms and conditions. In such cases, booking the Transfer or Tour may require full payment in advance and providing for different cancellation periods or other conditions that may be less favorable to the Traveler than ordinary conditions. Cancellation or any change may also not be possible in case of special offers, and cancellation may result in payment of the entire cancellation fee.

G. Prices and Payment Terms

1. Base Price is defined as the starting price for any Transfer or Tour and include all local taxes without any upgrades and/or extra services as indicated in Upper’s effective pricelist.
2. The Total Price is defined as the sum of the Base Price plus any extra/additional service that the traveler may request to add.
3. The Base Price does not include the cost of any products and services indicated in the Tour Packages and offered/provided by any third natural or legal parties (e.g. licensed tourist guide, tour escort, entry tickets to archeological sites/museums or similar site, tips/gratuities, restaurants, personal expenses, travel insurance, etc.). The extra cost of the above services shall be directly paid by the Traveler, in addition to the Base Price, unless otherwise offered/provided in the specific Tour Package with the specific Total Price. If in doubt whether something is included in the Base Price of the Tour, please inquire.
4. Base Price provided for Transfers are on a per group basis unless otherwise mentioned.
5. Base Price provided for Tours can be either on a per group basis or on a per person basis.

1. All Base Prices for Tours are described on our website www.upper.tours as well as in the company’s current brochures and they are valid for the time period referred to therein.
2. Our prices are subject to change without notice. Travelers that have already made a purchase are not obliged to pay the difference in case of an increase in prices. Upper is not liable for refunding the difference in the case of price reduction.
3. We offer the following payment methods: Credit Card, PayPal, Cash, and Bank Deposit.
4. Online Payment can be made securely by credit card online via our website.
5. We accept Visa, MasterCard payments through National Bank of Greece (NBG) e-Simplify system.
6. If online booking and payment is not a preferred option, please contact us to arrange an alternative payment method via PayPal, Bank Transfer or Cash.
7. Payment of deposits and final payments can be made by direct credit transfer into our bank accounts. Please note that if a credit transfer incurs bank charges they will have to be covered by you.
8. All online bookings are not considered confirmed until they have been paid for in full.
9. All tours payments must be cleared no less than 7 days before the starting of the service agreed, except for last minutes requests
10. In case of special requests and tailor made tours, multi day trips or groups over 20 participants we will request a booking deposit of 30% of the Total Price. In such cases deposits are payable at the time of booking and are necessary for the final confirmation of our services.
11. In case of Multi-day tours bookings including accommodation the balance of the Total Price is to be settled no less than 21 days prior to the starting date of the service.
12. In case of Multi-day tours bookings without accommodation the balance of the Total Price is to be settled no less than 7 days prior to the starting date of the service
13. In case of special arrangements we reserve the right to alternate the terms of payment. This will be noted on our financial offer and/or on our proforma invoice. Payment terms noted on a proforma invoice are valid for the per se booking and overrule the terms stated on this document.
14. It should be noted that, due to the various factors affecting the determination of the Price, which are beyond Upper’s control and for which Upper may not be held liable in any manner whatsoever, Upper may readjust the Prices and inform the Travelers in any appropriate manner. Such changes may occur up to 20 days before the start date of the corresponding Tour or Transfer.
15. We may offer you the following discounts, depending on the type of the Tour:
• Children and teenagers 13-18 years of age receive 20% discount on the available adult fare
• Children 2-12 years of age receive 50% discount on the available adult fare.
• Infants, 0-2 years of age (0-23 months) are not charged any fee.
It should be noted that different child discount policies apply for Tailor-made Tours. Additionally child discounts cannot be applied for any type of Transport Service.

H. Governing Law – Jurisdiction

Those who choose to access and use this website do so at their own risk and on their own initiative and are responsible for compliance with all applicable local laws. These terms shall be governed by and construed in accordance with the Greek Government Laws. Any dispute under these terms shall be subject to the exclusive jurisdiction of the Courts of Athens, by using this website, you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections as to jurisdiction or venue in such courts.
